1. Acceptance of Terms

By accessing or using the Sinefex website (sinefex.com) or any of our services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using our services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Our Services

Sinefex provides professional web development, tech solutions, IT consulting, and related digital services. We also offer digital products (software, templates, tools) and educational content through our Learning Hub.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of services.

3. Accounts & Registration

Some features of our platform require account registration. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and notify us immediately of any unauthorised access
• Not share your account credentials with third parties
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behaviour.

4. Purchases & Payments

All prices on our platform are displayed in US Dollars (USD) and are inclusive of any applicable taxes unless otherwise stated. When you make a purchase:

• Payment is processed securely through Stripe or PayPal
• You authorise us to charge the selected payment method for the full amount
• Orders are confirmed via email upon successful payment

Refund Policy: Digital products (software, templates, and downloadable content) are non-refundable once downloaded or accessed, except where required by applicable consumer law. For service engagements, refund terms are defined in the individual project agreement. If you believe you have been charged in error, contact us within 7 days of the transaction.

5. Digital Products & Licences

When you purchase a digital product from Sinefex, you receive a non-exclusive, non-transferable licence to use that product in accordance with its stated licence terms. Unless explicitly stated otherwise:

• You may use the product in your own projects (personal or commercial)
• You may not resell, redistribute, sublicense, or share the product with third parties
• You may not claim authorship or remove any attribution notices
• Source code access (where provided) does not transfer intellectual property rights

6. Client Projects & Engagements

For bespoke development and consulting work, the specific scope, timeline, deliverables, payment schedule, and ownership terms are governed by a separate project agreement or statement of work signed by both parties. In the absence of such an agreement:

• 50% of the project fee is due before work commences
• The remaining balance is due before final delivery or launch
• Ownership of custom deliverables transfers to the client upon receipt of full payment
• We retain the right to showcase completed work in our portfolio unless otherwise agreed in writing

7. Intellectual Property

All content on the Sinefex website — including but not limited to text, graphics, logos, icons, code samples, and design — is the intellectual property of Sinefex or its content suppliers and is protected by applicable copyright and trademark laws.

You may not reproduce, duplicate, copy, sell, or exploit any portion of our website or services without our express written permission.

8. Prohibited Use

You agree not to use Sinefex services or website to:

• Violate any applicable laws or regulations
• Transmit spam, malware, or any harmful or disruptive content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Reverse-engineer, decompile, or disassemble our software or digital products
• Impersonate Sinefex, our staff, or any other person or entity
• Engage in any activity that could damage our reputation or business
• Scrape or harvest data from our website without express permission

Violation of these restrictions may result in immediate account termination and legal action where appropriate.

9. Disclaimers & Limitation of Liability

Our website and services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Sinefex shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your access to our services immediately, without prior notice or liability, for any reason including if you breach these Terms. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

You may close your account at any time by contacting us. This will not affect any outstanding payment obligations or active project agreements.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the relevant courts.
